Starting July 15, 2021 (rather than July 1 as previously announced), fully vaccinated individuals do not need to wear a mask while at SJSU’s campus and other facilities unless they desire to do so. To provide sufficient time to gather necessary information and to meet and confer with our union partners, the requirement to wear masks for any and all activities at SJSU’s campus and other facilities will continue through July 14, 2021.
 
 
 
Cal/OSHA Emergency Temporary Standards (ETS)
The Occupational Safety and Health Administration (Cal/OSHA) Standards Board voted on June 17 to adopt the revised COVID-19 Prevention Emergency Temporary Standards. Governor Gavin Newsom has signed an Executive Order making the revisions effective immediately. SJSU will comply with all requirements set forth in the ETS and may require safety procedures, practices, or Personal Protective Equipment (PPE) that exceed any requirements set forth in the ETS. We will keep employees informed of any changes in workplace safety rules and procedures as a result of updates to the ETS.

The ETS allows for different procedures and safety rules to apply to employees depending on vaccination status. Fully vaccinated individuals will not need to wear a mask inside or outside while those who are not fully vaccinated will continue to be required to wear face masks inside at all times except when in a private office with the door closed. Masks may also be removed when eating or drinking.
 
 
 
Vaccination Verification Program (VVP)
Following appropriate consultation with the unions, SJSU intends to implement a Vaccination Verification Program (VVP) using a self-attestation form to determine whether or not you are fully vaccinated. While you will not be required to complete the self-attestation, those who do not complete it will be considered unvaccinated under the ETS. Please note that if you already attested that you were fully vaccinated for the Santa Clara County Vaccination Ascertainment requirement, you will not be asked to complete the VVP form.

“Fully vaccinated” means the person received, at least 14 days prior, either the second dose in a two-dose COVID-19 vaccine series or a single-dose COVID-19 vaccine. Vaccines must be:
  • FDA approved;
  • have an emergency use authorization from the FDA; or,
  • for individuals fully vaccinated outside the United States, be listed for emergency use by the World Health Organization (WHO).
Collection of self-attestations will be governed by applicable policies regarding confidentiality, privacy, and security of health records, as well as state and federal law. Information shall be used only for the specific purpose intended and only accessible to the necessary SJSU personnel. Information regarding which employees are fully vaccinated may be shared with appropriate administrators for the purpose of administering workplace safety rules and procedures.
