Retaliation is the taking of adverse actions against an individual because that person has exercised a right protected by law, opposed discriminatory practices, has filed a compliant or participated in any manner in an investigation or proceeding.

Adverse actions can include discipline, discharge, demotion, suspension, failure to hire, adversely affecting working conditions or otherwise denying any employment benefit to an individual.

The same laws that prohibit discrimination based on race, color, sex, religion, national origin, age and disability also prohibit:

  • Wage differences between men and women performing substantially equal work
  • Retaliation against individuals who oppose unlawful discrimination
  • Retaliation against individuals who participate in an employment discrimination proceeding
